As I see it, no worries

regarding patent protection for the pump. Apparently the pump has been enhanced so much that it's effectively a different device. Torvec filed a patent application for the axial piston device in February 2015. The patent was published December 2016. Now, CRGS may have even more applied for in the pipeline but you'd have to ask Kathy.

Now, regarding trade secrets beyond patent protection, you can be assured Kaplan isn't going to leave the test pump with any OEM unless he has a signed license in hand. Otherwise, they'll always be a Curaegis monitor present during testing.
