Mimurray ....Within my limited knowledge the Brokerages adhere to the 3 day settlement rule as it pertains to cash account clients being able to use the cash proceeds for other stock purchases or cash withdrawals . Margin accounts can use the sale proceeds immediately for other stock purchases , for a nominal interest charge .
The 3 day settlement rules makes the Brokerages look so darn tootin squeaky clean as the public presumes their angelic Brokerages are actually locating the shares purchased or transferring located shares that were sold by a client to another purchaser's brokerage account . The act of flipping exacerbates the problems of locating shares that may have changed hands dozens of times during the original 3 day settlement requirements . The sheer magnitude of variables
would make location virtually impossible , even if every share was a REAL , originally located share ....ie , who owns the darn thing now . IMO , because the MM's are lawfully allowed to use NSS to create a market and / or to create an orderly market , even blue chip companies on the National Exchanges have a perpetual NSS position , but that manageable NSS position could be covered and located if necessary . Such necessities seldom if ever occur due to the Brokerages GUARANTEES of ownership and guaranteed rights to SELL .
It is my studied opinion that the entire OTC and Pink Sheet Markets have become so convoluted with trillions of NSS since the advent of online , electronic trading that NSS of an equity that transacted 5 years ago ( for example ) has traded hands so many hundreds of times that no-one on earth could possibly know who owns real or NSS shares of ANY stock on these deservedly maligned markets . I think that is why the SEC grandfather all prior NSS at the commencement of Regulation Sho .
I do believe the SEC intended their forgiveness of all prior NSS to ethically compel the MM's , Brokerages , and other culprits to not engage in anymore NNS practices outside of the grandfathered NSS which would logically would remain NSS forever .
My unproven opinion is that the NSS culprits were so intoxicated from FREE money and from their omnipotent power to
continue NSS practices at will and with impunity that just by the magnitude and impossibility to ascertain a share's origins have perpetuated NSS of NEW NSS positions unabated . Possibly they thought / think that the variables are so exponentially complicated that they could easily hide NEW NSS into the grandfathered NSS and thereby remain undetected in perpetuity .
It is also my studied opinion that forcing a complete correction in the entire Markets would necessitate complete exposure to the massive and broadly encompassing CORRUPTIONS , and such revelations WOULD crash the entire markets , and our entire economies .
We are observing individual companies attempting to remedy the NSS in their particular stock . Hopefully only the Brokerages , MM's , and the DTC are penalized without universal consequences to the entire market system . However , should the groundswell of individual company interventions increase to include an icreasing number of prominent Nationally Listed companies , predicated on successes for righteous companies , eventually the entire Markets may suffer a dominoe fallout .
BKMP is garnering attention to more observers than we the invested shareholders . Should BKMP be successful I can see
a chain reaction in other companies attempting similar actions
and the momentum will become self-generating .
To me the gambit stakes are extremely high , and the Brokerages do not want to capitulate because of the possible chain reactions that should logically ensue .
