That is true. I’ve only been involved for the past couple months. As far as my thoughts why Apple hasn’t purchased or settled...I’m somewhat familiar with the court system in the US, though more with criminal Court and not patent infringement cases. Yes I realize VP sued for infringement, Apple was unable to prove their case with PTAB. I relate this case to any criminal case...the way our justice/Court system is set up, the benefits of settling early are minimal compared to the benefits of taking it to trial, since there are so many angles (and only one is needed) to potentially throw out the case or rule in favor of the defendant. Not only will Apple wait until the last minute to make their protests, such as what they just did complaining about the ex parte communication/letters by Sawyer, but they will delay every step possible. Why not, there’s no penalty. If this does make it to trial, they will file so many motions hoping one sticks and they get the case thrown out. And all it would take would be one. I hope it goes and VP is successful, but it definitely makes me wonder why Apple hasn’t settled or purchased the company. Maybe they don’t want to set precedence, thinking it would invite future lawsuits and cost more down the road?
I think this stuff is interesting. I likely have much less invested in VP than most of you but I still have hopes it works out well for us.
