Regarding Amarin v. ITC document 50 being restricted by court.

I contacted JT this AM, Amarin did not request the document be restricted. Amarin is a publicly traded company that has been ransacked by FDA misregulation, this has now led to 3 Federal Court case with direct departments of US Government.

I also contacted PACER and gave brief description of my opinion on the US Government action history, I request the court reconsider their reasoning for restricting the access due to public nature of complaint.

My response from PACER just now:

The court has at its discretion the option to make certain documents available only to parties in the case. If you are an attorney of record or another party in the case, you must enter your ECF filing ID before trying to access these documents. All others interested in these documents should contact the Court Clerk's office for information about viewing copies, as PACER does not have the ability to provide access to restricted documents.

I think it’s crystal clear the court restricted access; I do however have concerns the court isn’t considering the public damage done to AMRN. The Street doesn’t like uncertainty, it was expected this document would be viewable, who’s to say AMRN wouldn’t have traded up 75% or more on the news today?

Now we’ll never know....discretion will need explaining and I expect Amarin Attorneys file a motion to clear the questions of why the document is restricted.

IMO this isn’t a matter of simply redaction of a few paragraphs, I think the Court has good reason to restrict access and the reasons should be provided in this very public circumstance.
