Maybe more because Phase II hasn't been announced as being completed and operating. Revenues from Phase II won't happen for 3-4 months? And, even if the settlement is big enough to pay for Phase III, phase III completion is a year away?

Everyone is expecting a payout of $150 mil by Comcast.

I don't think it's going to be close; especially after the lawyers get their cut.
