You are totally confusing the issue. It is well known that proposals for new laws begin with lobbyists, administration or political think tanks... and not with Congress itself. All proposals by bank/MBA lobbyists, and political think tanks have been DOA. Administration has not submitted any proposals. FHFA has refused to even provide any meaning inputs for the reform proposals. So Congress can not be blamed for status quo. So your comments have no supporting factual evidence.

The basic principles of governance guide everything. If you think that this does not matter then the laws and constitution have no effect on outcomes. But often you come up with various laws and doctrines that affect the legal outcomes. So which one is true?

Court Litigations start with allegations or complaints. Allegation or complaints can be violation of laws or agreements. Courts decide what is lawful and what is not lawful.

In FnF cases, FHFA is using 4617(f) bar on judicial review to prevent Courts from reviewing whether FHFA decisions are lawful or unlawful. Please read 11th circuit ruling on how Courts decide this.
