I should think they could compile a list of delinquent filers. But "small print" doesn't really count. The delinquency notice is, as I see it, prominently displayed on the relevant issuers' OTCMarkets pages. People who "invest" in penny stocks are presumably adults. Adults shouldn't need for everything to be in a 40 point font.
