Cisco can NOT appeal because the 6 IPR petitions were not instituted. The Patent board would have had to institute the IPRs and a decision made in order for Cisco to appeal. However, Cisco's case was so weak the Patent board declined even to institute a review.

"NO APPEAL.—The determination by the Director whether to institute an inter partes review under this section shall be final and nonappealable."
