If he was not employed by WAVX at the time or WAVX did not pay any of the expenses associated with those filing, and there is no licensing agreement, whomever SKS is can file and assign to whomever he wants. I really do not know which patents are in question and the ownership issues. If however, he was an employee and had executed an assignment of IP to WAVX, even though the patent itself may not show an assignee, the "file wrapper" would show any change in assignment over the history of the patent. Fees in the PTO are lower for small entities (or individuals) and there is an obligation to inform the PTO when an assignment is transferred to a larger entity so the payments of maintenance fees can be adjusted accordingly.
