The only thing decided definitively in the suit against SA regarding the terminator was that they couldn't be forced to disclose the true identity of an anonymous author. In this case the author's identity is known due to his recent interviews where he comes out on his own due to pride in his work.

It's going to be interesting to see the response on the 28th.
