Quite the drama, and will be interesting to follow.
Unfortunately, based on the NNVC vs. PumpTerminator/SeekingAlpha lawsuit, I don't expect much to come of this one either, since everything on the SA is protected "opinion," and everybody is expected to know this.
The law states that opinions can't be "statements of fact" or libel.
Maybe Honig has a chance though, since the article was withdrawn with an apology stating it should not be relied upon (indicating the author acknowledges it was wrong/false). One might think perhaps that was bad advice. Withdrawn on 6/30, and suit served on 7/7. Another difference with NNVC vs. SA case is that defendant is known individual vs. anonymous. Would love to see the discovery process go through just to see who is collaborating with whom. Seems like a close-knit community of "shorters" who collaborate and mutually admire each other. They also work with hedge funds, or at least Mr. Drose apparently will be working with one if he isn't already.
Would love to shine some light on the cockroaches and see them scatter in panic!
