The SEC only suspended Harry P. Zhabilov's last ticker for 10 days. That is it! There were never anymore issues with it. Please refer to the DD from a BSSP shareholder. "After reading the old information about the temporary suspension of IMMB I went to the website below to search for any outstanding issues with IMMB.
The search shows no current 2016 regulatory issues or any litigation after the 2014 TEMPORARY SUSPENSION.
I called and spoke to an attorney friend and he says that the temporary suspension was upheld but that no further action was taken, meaning that the after the 10 day suspension had passed in late 2014 the SEC did not pursue any permanent suspension or expanded investigations. Unfortunately for IMMB and many other small sub-penny stocks the ten days they went with out a market maker the only recourse was to petition to have the TEMPORARY SUSPENSION lifted from the date that it was issued or become a fully reporting company which requires filing a 15c211 and completing three years worth of audits. This, being a fully reporting entity is what the SEC/FINRA and most investors want but what start ups or non-revenue companies can't afford and is why they choose to file under the alternative reporting standards of the OTC Market regulations.
IMMB filed a petition and the SEC upheld their temporary suspension but took not further action because without a market the stock cannot trade and they will have to go to the expense of the audits and filings.
If you go to the SEC website and type in Immunotech Laboratories, Inc. under regulatory actions you will see that there is nothing currently listed under Harry Zhabilov or Immunotech Laboratories, Inc.. Under litigation and Everything the temporary suspension shows up which has been resolved. No further action was taken and the TEMPORARY SUSPENSION was upheld. That does not mean the company did anything wrong as the petition states their position but that the SEC felt justified in the TEMPORARY SUSPENSION and up held it.
The key is no further action was taken from over a year and a half ago.
Because BSSP is abnormally late with their financials and Zhabilovs previous run in with the SEC I wouldn't put any faith in that response from the so called company. In fact that response isn't even worth the paper its written on.
