This one says the plan proposes to cancel all shareholder shares - it doesn't say they will be cancelled - that will be decided by the judge
Not exactly. The Judge has to follow the law, and since there are not sufficient assets to pay even the unsecured creditors, much less the preferred shareholders, the common shareholders get nothing. The Judge cannot violate the law and provide the common shareholders with anything, especially since the Plan has already been approved by the unsecured creditors who agreed to receive only 67 cents on the dollar.
The Judge cannot, and will not, change the Plan. There is absolutely no legal basis to allow it.
