No when the court orders the sale of assets to pay off debtors its a liquidation.

When a company sells an asset its called business.

The company would not be allowed to sell an asset today and file for BK tomorrow without forfiting the proceeds.
Most likely the court would cancel the transaction.

Bottom line is until the filing is nade they are not in bk and are not liquidating
