I was always taught possession is 9/10th's of the law. If you
posess the title to anything no one else is supposed to use it
with out your permission. If you have not granted the chipmaker
the right to use what you possess then explain why you have a
patent and they can up and use the technology what part of the
possession did we miss? Would the chipmaker have to prove the
patent was invalid and be out the money as well as unable to
produce the chip till it was resolved?
Bulldzr I appreciate your suggestion but daamnit I think when one
owns a patent that is a title and no one can confiscate your car
and drive it till you carry them to court. What thee heck is the
difference? If you can't ask for a cease and desist using your
patented technology why are we so dumb as to keep patentning
technology that is worthless according to what is said here.
What right does a patent owner have?
Am I stupid no doubt I am but so far no one has made me understand
I have the title to a patent and any sob in the world can use it
and not have permission. If anyone takes anything from someone
who has a title to it and they are not granted permission to use
it to the best of my knowledge they call that stealing. Go take
a car and see how that winds up. In fact if someone takes your
car you don't have to file a court case to validate the car is
yours and the person that took your car just has to return it
and that's it no criminal charges. To the best of my knowledge
a APB is put out for your car and if they catch the driver they
go to jail. Now I have the title to a patent and all of you are
telling me any of you can use it till I sue and prove the title
our patent office granted me is valid. Heck of a way to do
business and a far cry from what I was taught about stealing.
Why is it with the SEC the old statement of he who sells what
isn't his'n can't deliver goes to prison. Just got to be sure
you deliver if you short or so I am told. I am only asking that
no one make or in anyway profit from my technology till a court
decision renders the patent invalid. If that happens then what
do we need a patent office for that can't validate a patent before
they issue it?
