Not be a lawyer but I would think the chip manufacture would

have to sue you and prove your patent was invalid. I would think

a patent owner has the right to request a cease and desist even

if the chipmaker wasn't selling the chip to unlicensed

manufactures. If you own a patent you have a right to allow

use of it and it is to be licensed or given away but you till

they prove your patent is useless you are the owner and therefore

say who can and can't use your patented technology. If that is

not the case why even have a patent office.
