Sell shares and jeopardize their case...at this point they probably have a very significant expense on attorney fees...and then to risk the opportunity to cover their expense by selling shares? How does that make any sense? I don't think his shareholders will want to hear THAT news of how he mismanaged/misjudged his lawsuit...
