I see no path where escrows can get anywhere near the 40 billion you are talking without a lawsuit. I can't see a billion knowing how jpm does biz without a lawsuit.
Let's say the dd'ers are right, it would be the biggest return of assets to share holders in the history of bk's. It would be a case study for decades and set a new dynamic in bk law. It would be the biggest financial news event since the 08 crash and their would be reporters, congress, the sec, refiled lawsuits claiming higher damages against wamu etc.. It would open pandora's box and there is no political coverage. There would be a new set of congressional hearings, there would be news articles about a cover up etc..
I have been a full time trader for the past 20 years or so. A long way from my corporate career but much more enjoyable. My bread and butter for the first 10 or so years was tick trading and never holding any positions over night and for the last 10 years I trade options on commodity futures. During that entire time I have always found trading in bk's fun and entertaining. I am mentioning all this because it leads to one point, I have never seen a bk work out to the share holders advantage. I know there have been a couple of times in smaller bk's where the vast majority share holder (usually former owner) fought for share holders and share holders came out whole. But in any bk controlled by a bod I have never seen the shareholders win. It doesn't mean a trader couldn't make good money flipping the pinks back and forth for a couple of years until the mm's were done playing with it, but I have never seen a bk where long term share holders sitting on their shares win. Why, because the game is rigged and the courts don't care and lastly, unless a lawsuit is filed it is not comprehensible for me to think that jpm or fdick are working on behalf of escrows. We have zero representation, susman has billed practically nothing over the last 3 years compared to rosen who is in bed with jpm. so how do escrows win. I see no path.
