Oh come on!? Investors should be prosecuted?? That's outrageous. You discredit yourself. The vast majority of investors are doing the best they can with what limited time they have to pick the most hopeful and legitimate companies they can find. To prosecute innocent investors for making imperfect decisions based on extremely limited information would be to destroy the stock market itself, and capitalism along with it. How naive. I do agree that we must prevent fraud and prosecute those committing fraud. But the current system is deeply flawed and totally at odds with a free, open and democratic society. We need full transparency and legitimate accountability--two things FINRA utterly lacks.
