JJ did make a couple of decisons, right?
He did say that there would be no fourth phase and that
the depositions could be split. That was one for bus and one for mike.
I also read the 'far better position' differently; I thought that
the mikey guy let enough of that phrase slip out (implying that JP would do a better job than JJ) before catching himself and restating it as a very good position; and I thought that JJ was needling the atty for suggesting that JP was better than JJ.
the slickness of mikey was to play the 'cuts both ways' card,
suggesting that bus was working both sides of the street when it is mikey that is doing that very thing. In any event, the court did agree to expedite their consideration proportionately to bus's expedition, and to handle everything together.
I note that the court may have save some shots for next time; there was no mention that adding a new quickie action is inconsistant when both parties agree they are very busy with the upcoming JJ trial. I thought the pivotal moment came when MG did volunteer (without prompting?) to turn both of the bus responses ultrafast, so both things could be heard at once,
to address the 'cuts both ways' comment. I thought JJ comments were encouraging, regarding prompt court time (requesting to know if the parties are not cooperating on booking the hearing).
Another unspoken message was that he was spending a whole lot of time scheduling out the details of the case, and it seems unlikely he would be very happy about having conflicting decisions from JP.
You certainly didn't hear any deferential comments about JP from JJ. Just as MG knows how to write a compelling note, I expect she is well-tuned-into the nuance of JJ. Her unprompted (also not negotiated during-the-call) offer to turn the responses in 24 hours says to me that she read JJ as being 'on the fence' and needing to give him another chance to agree. I probably should re-read the script, but that was my impression. Big thanks to msaba and Docrew. Amazing access!
