BlackBerry producer willing to pay higher cut of U.S. sales in patent dispute Kevin Restivo and Theresa Tedesco, National Post

Font: * * * * On the eve of a court hearing to determine the BlackBerry's fate in the United States, Research In Motion Ltd. said it is prepared to pay a higher cut of its sales from the wireless e-mail device to settle a bitter patent dispute with NTP Inc.
James Balsillie, RIM's co-chief executive, told investors the Waterloo, Ont.-based company would be willing to pay NTP the rate they asked for from future U.S. BlackBerry sales as long as RIM can secure reasonable licensing agreements. NTP, the U.S. patent holding company, had been demanding 5.7% of all future BlackBerry sales south of the border during its settlement discussions over the past year.
"Would I do a [deal] today that would protect [RIM's] ecosystem at the rate [NTP] said? Absolutely! Just to get it done with," Mr. Balsillie told a business audience at a technology conference in Whistler, B.C.
A source at NTP, who asked not to be named, told the National Post Mr. Balsillie's comments were encouraging and could form the basis of a settlement to end the protracted legal battle.
"No, we have not heard that offer before," said the source. "It is appealing to us."
Previously, Mr. Balsillie said publicly that RIM was prepared to give NTP only a 0.5% slice of all future U.S. BlackBerry sales for the remaining seven-year life of NTP's patents.
The four-year-old dispute could lead to a shutdown of BlackBerry service for some two million U.S. users, including politicians, businessmen and celebrities.
RIM has argued the device, nicknamed the "CrackBerry" for its addictive nature, is vital to the economic well-being of the U.S.
Today, lawyers representing RIM and NTP will present arguments on a proposed shutdown of BlackBerry service in a federal court in Virginia. NTP wants Judge James R. Spencer to uphold an August, 2003, injunction he imposed on the sale of BlackBerry devices and software in the United States. RIM appealed the court's decision and the injunction was stayed in the interim.
During yesterday's 30-minute investor call, Mr. Balsillie said the stumbling block in settlement negotiations remains patent ownership. RIM wants NTP cede ownership of the patents after seven years.
"Would [a deal] last for another 10 or 20 years and give protection to my business? Not in a million years," he said. "Would I do a deal that does not give protection for my business? Not in a million years," he said. "We need something reasonable so that we can run our business."
"I don't know what's he talking about," the NTP source said of Mr. Balsillie's comments. "We have said all along they can run their business."
In a release late yesterday, NTP said its proposed licensing deal would protect RIM indefinitely. "NTP has offered RIM a license that fully protects everyone: its customers, carriers, and partners," the company said. "It is RIM's choice not to protect its customers, carriers and partners."
Last March, the companies agreed to settle the dispute for US$450-million only to have the deal fall apart three months later.
"It wasn't about money. They would not give us terms to allow us to continue on with our business," said Mr. Balsillie said at the conference yesterday. "We took it to an outside licensing counsel that said we would be crazy to take those terms."

RDXM News RDXM Homeland Security SILVERDALE, Wash.--(BUSINESS WIRE)--Dec. 21, 2004--Radix Marine (OTCBB:RDXM), a marine vessel development company specializing in port and homeland security and defense initiatives, today announced a series of actions to build its manufacturing operations, including delivery of its first homeland security products for the Washington State Patrol.
"These actions are designed to increase our light manufacturing business, as well as to enhance and streamline the efficiency of our in-house manufacturing capabilities for our boats," said Kathy Bright, president and CEO of Radix Marine. "Our move in August to add in-house manufacturing capabilities through the acquisition of our own facility is giving us greater control over our manufacturing and R&D efforts, while our decision to add light manufacturing is helping us test the efficiency of our capabilities for our core boat business. Our goal continues to be maximizing the production capacity of our manufacturing facility."
As part of its light manufacturing business, Radix Marine has constructed and delivered its first homeland security products for the Washington State Patrol. The products are high tech kennels to house the canines being trained to patrol the Washington State ferries, and have been constructed with funding from the Department of Homeland Security. In addition to the Washington State Patrol orders, the company has broadened its customer base for its light manufacturing services to include steel beam work for the upscale home construction industry.
"Taking on projects of this nature helps us test the efficiency of our manufacturing facility for our boat contracts, which we anticipate will provide an even revenue stream between boat contracts," said Bright.
In Radix Marine's boat business, work is underway on its contract for two prototype manned vessels with a marine technology company Advanced Marine Concepts, formed by Philip Whitener, a retired Boeing test engineer and Eric Anderson, CEO of Art Anderson Associates. Codenamed "Dragonfly," the prototypes will demonstrate proprietary new ultra high efficiency technology developed by Advanced Marine Concepts for high-speed passenger and car ferries. The design combines surface effect ship and hydrofoil technologies. In addition to the prototypes, the company has added additional staff at its manufacturing facility, including welders certified to ABYC/Coast guard standards for the marine work, and certified to WAVO standards for the construction work. The company also plans to continue to add new capabilities to the manufacturing facility through the acquisition of equipment with the goal of becoming a full service metal shop with cut, break, bend, weld, and other forms of fabrication capabilities by the second quarter next year.

SAN DIEGO--(BUSINESS WIRE)--Dec. 20, 2004--International Sports and Media Group, Inc. (OTCBB:ISME - News) announces Total Soccer Network (TSN), its Soccer Internet Media Division, has signed an agreement with SmartSMS to develop, host and deliver real time soccer, news, scores, stats, trivia, video clips and other content to Total Soccer Network (TSN) subscribers.
Total Soccer Network (TSN) executive Gareth Maden stated, "With our focus on real time delivery of soccer news and video, the Total Soccer Network (TSN) is looking forward to utilizing SMS technology to deliver up to the minute soccer news and video to our database of diehard soccer fans. Mobile subscription services will play a key role in maximizing the use and profitability of our content. This agreement will not only help us sell more to our existing subscribers, but it will also make our content available to over 180 million potential mobile phone subscribers in the US alone."
Total Soccer Network is a growing network of soccer oriented online properties encompassing both areas of revenue generation and content sites to effectively blanket the online sector of the sport. The goal is to grow the network though organic site development, prudent acquisition and joint ventures. This strategy has been highlighted most recently in their acquisition of the high profile site www.ussocceruk.com.
Maden continued, "Part of our overall vision is to generate revenue by creating direct one-to-one links with soccer fans both on and off line by using the latest in mobile technology to deliver premium content to subscribers, both in the US and abroad. Premium SMS in Europe has grown into a billion dollar a year industry and has been used by soccer clubs across Europe to engage soccer fans in ways never experienced before. Here in the US, we are witnessing a tremendous growth in the use of mobile data services such as text messaging and we're preparing to make the most of this trend by repackaging our content for use in this new age of mobile content delivery."
SmartSMS VP of sales Clarence McDowell says, "For millions of soccer fans worldwide, soccer is not just a sport, it's a way of life. Today's soccer fanatic wants more than just scores, they want the inside scoop on players and teams as it happens. SmartSMS will assist Total Soccer Network (TSN) to meet this demand by implementing a premium SMS service that delivers soccer news and video clips direct to the mobile phones of Total Soccer Network (TSN) subscribers. Total Soccer Network (TSN) mobile alert service will generate revenue two ways: first, by charging a per message fee for each alert sent to subscribers, and second, by billing advertisers who want to send coupons, promotions or other incentives to subscribers. As the 2006 World Cup in Germany approaches, we believe Total Soccer Network (TSN) is in a perfect position to capitalize on the increasing demand for soccer news and video as billions of people and thousands of advertisers worldwide begin to draw their attention to everything soccer."

New Security Measures
November 26, 2003
The Office of General Services and the Division of State Police are announcing that on January 1, 2004, new security procedures for accessing the State Capitol and the Legislative Office Building will be implemented. The measures are part of the State’s ongoing review of security procedures at State facilities and will utilize state-of-the-art technology to reduce staffing costs and improve security operations.
To improve and streamline security operations at State facilities throughout New York, OGS will begin phasing in on a statewide basis a single, state-of-the-art, employee ID card that will replace multiple cards being used by State agencies and the Legislature. The new, “Smart Card” technology is compatible with multiple systems, allowing one card to be programmed to serve a number of different security-related functions. The new card is expected to improve security at State facilities and allow unhindered access for authorized employees at individual state buildings and facilities. Rollout of the new ID cards will begin this month with employees working in the Legislature and the Capitol and is expected to be complete by Spring 2004.
All persons requiring entrance to the Capitol and Legislative Office Building will be required to use their new ID card to go through the new employee turnstiles. These devices will be installed at the Times Square quadrant on the Concourse level, the Washington Avenue and State Street entrances to the Capitol, and the State Street entrance to the Legislative Office Building.
During business hours, those employees whose agency has office space in the Capitol and Legislative Office Building will have access authorizations to these buildings assigned to their ID card. Employees whose Agency does not have office space in the Capitol or LOB, but who routinely must do business with those Agencies, may apply to have authorization access granted on an individual basis. Permission may be requested by Agency Contacts to the OGS Security Card Officer. If a person attempts to pass through without prior authorization on their ID card the barrier arm will remain in place and an audible alarm will sound to alert security personnel. Any employee without authorization will need to pass through the visitor’s entrance. Buildings will remain open and accessible to the public during business hours by utilizing the visitor’s entrances, which will be clearly marked. Security personnel will be available to assist.
Capitol and Legislative Office Building employees who require after hours access to the buildings will be allowed to enter these buildings through secure portals. Secured portals are designed to allow only one authorized person at a time through the portal. The employee will scan his or her card to enter the portal. Doors will open and the portal will scan to detect one person, upon clearance the doors will close, and the second set of doors will open to allow the employee to pass through. If the portal detects more than one person, a voice synthesizer will request that the individuals exit the portal. If the employee attempts to pass his or her card to another person after having scanned to enter the portal, the portal will deny access to the second person.
After hours access to the Capitol will be afforded at State Street and the Capitol tunnel. Legislative Office Building portals will be located at both the Swan Street and the Plaza entrances. These devices will allow authorized employees the ability to come and go from the Capitol and Legislative Office Building both during and after hours utilizing their new ID card and pin number issued by OGS.
The Legislative Office Building’s main entrance will be on State Street. This entrance will include features similar to the Capitol including a magnetometer, x-ray machine for visitors and an employee turnstile for building occupants. After hours access will be at the Swan Street and the Plaza exterior entrance to the LOB through a secure portal. Also, the P-3 V-lot and P-2 entrances into the Legislative Office Building will be altered to allow only authorized employees via full turnstiles operated by the employee ID card and pin number.
Barrier gates to prevent unauthorized vehicular traffic will be installed at the Madison and State Street entrances to the Empire State Plaza, Capitol Executive ramp, and the Bus Terminal at the Empire Sate Plaza. These gates will permit access to authorized vehicles only.
We are confident that everyone will work with Security personnel to make the Capitol and Legislative Office Building as safe and secure as possible. Please do not hesitate to contact Mr. Joseph Cosenza at 473-6517 or the Plaza Manager’s Office at 474-8894 if you have any questions or concerns. Thank you for your continued cooperation.
although "Secured Portal Systems" is not mentioned by name in that article,I think its a very good possibility that they are the supplier because of the fact that they already have the NY Police, NY Corrections and others listed as customers on their website All IMO but I believe this stock is headed much higher, could be very long term
I tried to post that on Raging Bull but there is so much garbage being constantly posted that it gets buried in a hurry, that board is pathetic IMO
Heres something I found that might be related to FXGP (hopefully)

Please do not hesitate to contact Mr. Joseph Cosenza at 473-6517 or the Plaza Manager’s Office at 474-8894 if you have any questions or concerns. Thank you for your continued cooperation.
