Tax Loss: Losses on your investments are first used to offset capital gains of the same type. Cowboy: a statement such as "resounding success" is meaningless IMHO unless one defines it as simply showing up to FOSE, but there was no qualitative or quantitative substance to back up those words such as definitive orders or contracts. Being realistic and logical, IMHO what government agency(s) would consider doing business with CK when two other government entities (FBI and SEC) allege securities fraud against CK? Secondly, let's us assume the purchasing agent(s) don't know of the pending allegations nor does the company reveal it, then what would be the fallout once that became knowledge to those agents and they already placed orders?

The SEC saw enough to charge Mr Plant and the company with alleged securities fraud. The FBI arrested him on charges of alleged securities fraud. So I think I saw what the SEC and FBI saw, and you have not.

U3 is open source technology developed by sandisk and m-systems and readily available for download to any usb flash drive. Additional programs have been developed specifically for the platform, and available for download at a price.
Any company can claim vertical markets it is going after. It has a few listing on wed sites. Please provide documented sales and revenues to validate any success in those verticial markets. Please substantiate any contracts. Please provide substantiated software solutions wrapped around the flash drives specific to your "market focus" areas. I have not seen any including the MyFanKey or its related portal advertisied in Nascar, as a recent example. I have not seen any for ChildIdKey, medical, insurance, automotive, finanacial so please direct me to them.

Strange how the model numbers at SuperTalent download site mirror those of CyberKey, along with the software. However, still NO software bundle despite my attempts to get it from the company. Therefore, the advertising on the CK web site for the Enduro is FALSE.
There is NO substantiated DRM patent. Please provide the patent number, along with information of what Mr Plant claimed was his proprietary chip for embedded serial numbers on his flash drives.

However, my information comes from an IT security engineer who answered my inquiry concerning FIPS 140-2 who is associated with the NIST/CSE, as referenced below:

It entails testing the security of customers' systems, providing OPSEC assistance, and evaluating commercial software and hardware against nationally set standards, to better meet our nation's IA needs
The IAD is Information Assurance Directorate, a division of the NSA.
The CMVP is a joint effort of NIST and CSE (America and Canada) which jointly developed the FIPS 140-2 certification for encrypted modules, such as usb flash drives for 4 levels of security with Level 4 being the most secure for sensitive yet unclassified data.
FIPS 140-2 is applicable to ALL federal agencies UNLESS the cryptographic module has been approved for classified data use which may be used in lieu of the FIPS 140-2. The NSA is, as noted above, responsible for testing commercial software and hardware against nationally set standards.
Until proven otherwise by you or the company, then cyberkey solution's claims of unclassified and classified drives is unsubstantiated. Now you may want to telephone Mr Plant on the bat phone and ask him to "prove up" the claims so he may put the issue to rest with his certification numbers. Right now I'd settle for a cert number on the FIPS 140-2, or AT THE VERY LEAST, inform us as to the EAXCT date he submitted each drive being allegedly sold to ANY federal agency for FIPS 140-2 certification along with the date of expected approval and certification.
That should not be much to ask for starters.

Intel is getting into solid state flash drives as eventual replacements for exisiting hard drives much like other WELL KNOWN and RESPECTED leaders in the industry. No correlation between their developments and flash drive sticks from cyberkey which strongly appear to be supplied by supertalent IMHO and resold with the cyberkey logo.

jking: I spent alot of time on that issue even emailing engineers directly involved with FIPS-140 and the certification agency and it was emphatic it was necessary, and in fact, was the requirement for sensitive yet unclassified data. NSA deals with certifying for classified encryption devices. Be that as it may, my requests to the company to resolve the issue were ignored.
jking: do you recall when Jim Plant was saying CK had the only patent on BBM and an official with M-systems (now part of Sanddisk) said M-systems developed it 10 years prior.
U3 is open source development, and software developers are coming up with software to run directly from the flash unit, but what is interesting is none have been able to run MSFT software yet. Keeping that in mind, JP in an interview claimed to be able to run MSFT apps like Excel directly from the drive. Amazing.
jking: that's whay I also raised the question on the other board about the alleged unclassified and classified drives that CK continues to promote, as my reaearch and communications with government officials clearly state they must be either FIPS 140-2 certified for sensitive yet unclassified data, and the NSA certifies for classified.
Also, take a look at FTDI chips, and tell me if that doesn't sound extremely similiar to what Plant was claiming as a "proprietary chip" for CK...serial numbers burned into the chips.
dcbass: I'd still ike to be enlightened as the certifications FIPS 140-2 and NSA certifications to label the drives as classified and unclassified...or are those just "buzz words" for 128-bit versus 256-bit encryption tied to a "burnt in" serial number on the chip such as those designed by FTDI chip? This issue has NEVER been clarified by the company under the guise of being top secret since it was allegedly selling to the DHS, military and other federal government agencies to the tune of $25M. Can you shed light on these classifications, since you visted the company?
Interesting Tech Note: A unique number (the FTDIChip-ID™) is burnt into the device during manufacture and is readable over USB, thus forming the basis of a security dongle which can be used to protect customer application software from being copied.

So, the obvious question is where is this alleged patented DRM and BBM that allegedly made the drives so unique? You will recall that JP said it was on the chip, but then in his IBC radio interview he said it was a "soft" DRM solution. ST sells flash drives to whomever has the money and wants them, then slaps a logo on it.

Nohypenobull: CK does not have its own product. It is not a manufacturer, but a reseller of another manufacturer(s) product, CK pays to have its logo placed on it, a package designed for it. He touted patents of DRM and BBM along with trademearks. He continually declined requests to prove the patents under the guise of "provisional" to keep them secret. Even searches for trademarks such as "secure advantage" never appeared on the patent/trademark web site. No web portals allegedly tied to this reported technology ever appeared including the most recent one for MyFanKey, as advertised in the Nascar guide. These alleged patents and associated technology would have been on display at CES for all the indusrty to see and witness. Where were all the alleged solutions wrapped around the flash drives, as none in the marketplace that I ever saw. IMHO it is nothing more than wishful thinking, part of the overall deception for which he and the company are charged with alleged fraud. Logically thinking here for a minute...if you had these alleged patents, solutions etc wouldn't you in his current position be looking for someone to buy it, or partner with to get out of this money and legal quicksand? In fact, wouldnt you have already lined up partnerships? Big names in the industry knocking down their doors with deals and offers? Instead the company is at Fose trying to sell keepsafes and biolocks that it does not produce. Look at X4 technology for flash by Sandisk, for example, and see how they partner up.
Gabeh: go to super talen and look at their flash drives and the sriking similarity to those offered by CK, and also notice ST will place logos on them for other brands. I received one Enduro I could not get to work even with the alleged download software from CK. I had to get the utility from an FTP via another tech site. ALso, look at ST and their software download...see the exact name of the drive type as listed on the CK downlaod site such as:
Driver Download for STF_UT_USB20 and the CK one is Driver Download for STF_UT_USB2.0. Imagine both codes

Ice: I concur. I see the recent concentration on SCE as nothing more than an attempt to divert attention from the parties presently being implicated in the alleged fraud.
SCE is a tout site, never hidden from that fact, never hidden they were paid with shares. Fact is some pumpers saw it as no big deal at the time, and even stated 5-milion shares paid to SCE was nothing compared to 700-million O/S.
Was it appropriate for SCE to post on the other board? IMHO probably not due to the nature of their business. However, SCE also owned shares which it earned for services provided. The philosophical question then is who has the "right" to post? Only those who bought shares? Only those who still owned shares? Only those who would prove up shares?
Right now, the investigation continues IMHO and we will eventually see who else may be charged, and who may be exonerated. I believe that is a logical assumption and opinion.

More Discrepencies: Seems JP still can't get his story straight when he issues any press release:
Last week, CyberKey said in a release posted on its Web site that in November 2006, it began to discover that a contract with the Department of Homeland Security "was not directly with DHS but instead with a third party distributor" and that "none of the products supposedly sold to this third party distributor had been delivered to DHS."
Then the SEC states.....
“In September, the DHS ordered Plant to immediately remove the news releases from the company Web site and stop making any references to contracts with the
department.”
