Scanned today's USPTO Gazette, and did not find anything for us. Am I missing something, or are we just going to have to wait another week?
Still a lot of positive comment on AVNR over on yahoo finance, including mention of an analyist recommendation. The discussion here seems to have waned, but I think the next 6-8 months could be quite exciting for AVNR.
AXTG mentioned again in New York Times "Green, Inc." Blog:

Fast food joints are a prime target for more active energy efficiency efforts.
Like the article said: “food service restaurants have different needs than ordinary buildings, where lighting and air-conditioning tend to account for 75 to 80 percent of power use.”
With all the windows most of these locations have, basic one way tinting of those windows and dimming fluorescent lighting (from companies like Lutron and Axis Technologies) are no brainers. Another basic is ceiling fans and lower A/C temperatures. And many of these solutions are underwritten through rebates offered by many of the utilities.
The way to reduce costs in buildings such as these fast food locations are available and the prices are coming down. The will to change has to be present too.

Pink Sheets get leniency. I do not think the deadlines are really enforced on the Pinks.
Strange. Now the TD Ameritrade qute source indicates .147 x .15, but the trading quote bar still shows ask of .17 Must be a glitch.
Interesting? I'll say. TD Ameritrade is now reporting a real time quote of .147 Bid and .17 on the ask. that is quite a pread for this stock. Haven't seen any trades go through there, and volume is light.
Thanks Southern. I thought that was the case, but with all of the pointed questions on this subject of late it is nice to resolve the issue.
I took Southrn's comment to mean this morning, but remeber that the 10Q for First Q 2009 stated specifically that, as of the end of the 1st. quarter, they had approx. $3/4 Million in purchase orders on file for the new T8 ballast that could not be filled and shipped until the UL listing was issued.
Good point Southern but, in your opinion,is the issue of a patent on the new ballast that important given the existing patent on the incorporated technology component(s). It is my understanding that the new ballast is "patent pending," but isn't that also tied to the existing patent on the internal components and process tying the photosensor in with the rest of the operational technology?
Reviewed the request for extension of time and everything looked great to me. The request for the extension of time to file the appeal brief was because the appeal brief should now be unnecessary, due to the projected issuance of the NIRC following resolution of all issues on the recert, and he was just preserving his position and covering the base.
I picked up a different link from post 10436. Is that the same thing and the same group of documents?
Still no luck. The long link of over 100 sybols that runs off the right side of the page only leads to the site, and you still need the actual patent number. Can't find anything.
Perhaps the patent recertification which some believe is already a done deal.
He won't ever contact them or IR, as he does not want anyone to know who he really is.
Q: I think that once again you are off base. It is my understanding that the patents already cover the component technology which is incorporated in the new improved ballast, and that is the key. Technically, they may not need a complete new patent as the base compent technology linking the photosensor with the ballast is already in place. Nevertheless, it is my understanding that the complete new ballast is "patent pending." I think you are once again raising a non-issue in an attempt to run the company and its products down..
Yahoo board exchanges re: imminent buyout do not seem credible given news this a.m. out of AVNR:
Market Report -- In Play (AVNR)August 27, 2009 8:31 AM ET
Avanir Pharmaceuticals raises $10.6 mln through the sale of common stock via sale of approximately 4.5 mln shares at $2.34/share

Yes. Everything should break positive with the UL approval which should come sooner rather than later.
Understand that UL was in China examining the manufacturer and production lie earlier this month.
Post 2062 - 8/14/09 on the USA article on the delay in distribution of Obama administration stimulus funds for energy savings.
The wetherizationi funds in the stimulus package may be gone but, as recently reported by USA Today and others, the stimulus package dollars for lighting and energy efficiency in corporate buildings wer not even distributed as of a few weeks ago. Once again, you have not done your homework and are spewing out pure fiction.
Anyone truly interested in AVNR should check out the AVNR board over at yahoo finance. Incredible volume of discussion of late, but hard to sort out the credible fact from the hype. Many posters over there seem to think we are on the verge of a major announcement within a matter of days. Time will tell.
Well stated Doobeedoo. Unfortunately, he has evidenced that the facts do not mean anything to him, either here or over on Yahoo.
Sorry meant to say over on the AVNR board at Yahoo Finance. It was crazy a while back with several posters claiming to have all of the straight info. who knows whether they have any basis for what they are claiming, but there sure was a large spike in volume on the upside, which appears to be prior to the posts over on yahoo.
AVNR srging on increased volume, apparently due to rumors of an imminent buyout over on yahoo board.
AVNR surging on increased volume based on rumors of imminent buyout over on Yahoo baord.
AVNR popping up hard on surge in volume on rumors of imminent buyout.
AVNR poping hard on huge volume due to rumors of imminent buyout.
Think I figured it out. Huge chatter and rapid posts over on the AVNR with speculatino over a buyout announcement withuin days (one person claims pre-market monday), and posts re: "thanks Goldman", shorts are covering, etc. There is also a suggestion that TEVA has been accumulating shares in the $2 range in order to average down cost per share, etc. Lots of chatter but no confirmation that any of it is legitimate. Anyone interested in AVNR may want to check it out.
Significant spike in volume and share price in last 20-30 minutes, but I cannot find any news or figure out why? Anyone have any ideas or information?
Sorry to lose you, but if you had a low enough entry point and got out with a profit I can understand. You may have a chance to get back in. The problem is that full FDA approval is probably a year away according to the company, and that is a long wait for significant news. But, IMHO the upside potential is so great that it is worth holding the position.
Vicstock: What is the basis of your view that UL approval will take another 2 months?
Thanks. But, I do not have the patent number, etc. handy. It seems you need that to pull information from the PTO site. Can you or someone else go in and pull the information off this public site and post it on the board?
TONE is still breaking upward with good momentum , and still way below book value.
TONE breaking out with hard upward momentum, and still trading far below book value.
TONE has clearly broken out and has hard upward momentum. Still trading way below book value of $13.50+

Green technologies have always had a challenge to make a broad impact in the market–usually because of the cost and the usual extended Return of Investment (ROI). And when you factor in the cost of REPLACING the older lighting fixtures, for example, when they are still operating just fine, thank you very much, you have another hurdle.
What is encouraging is that more and more OEM’s are including the new technologies in their new products, so that concern of “wasting” a perfectly good fixture etc. does not hold the same importance as before.
Daylight harvesting (DDH), as mentioned earlier in some posts, have been adopted. I checked the Daylight Harvesting page (if they had one) and found the company mentioned before, Axis Technologies, at two OEM websites.
Apparently, that company, Axis Technologies, actually has made some inroads with Original Equipment Manufacturers (short for lighting fixture manufacturers). A subsidiary of Philips NV, Crescent/Stoneco, uses their technology for their energy saving fluorescent lighting fixtures. Another one is Simkar, a lighting fixture company around since the early 1950’s, also uses the Daylight Harvesting ballasts of Axis Technologies.
I found the two direct links on their respective websites showing that at least some OEM’s are using Daylight Harvesting in their original manufacturing of lighting fixtures. There may be others OEM’s I am not aware of. And there may be other daylight harvesting technology used by other OEM’s, but I did not find any in my search.

Simkar Corporation Daylight Harvesting: http://www.simkar.com/daylight-harvesting/Simkar%20Daylight%20Harvesting.pdf
Daylight harvesting is just one of many energy saving ideas, but it seems like one of the easiest to adopt. Solar energy systems are understandably very expensive and the payback period can be long, depending upon the climate.
But it is looking like that in a few more years, ground breaking technology will most likely be broadly used. LEED certified buildings are getting higher rents and have a cachet in the rental markets.
Encouraging all, just would be nice to see the pace quicken.

And they are still puchinhg the Axis ballasts and incorporating them into their fixtures.
What is the basis of your belief that this will happen this week?
CRESCENT/STONECO (Div. of Phillips Group) incorporating Axis ballasts into its lighting fixtures:
LIGHTING SOLUTIONS FOR YOUR WORLD
The Crescent/Stonco Supply Division, a Philips group brand, combines two leaders of the lighting industry, Crescent Lighting and Stonco Lighting, in one location for your best selection HID and fluorescent lighting products. Crescent/Stoneco provides lighting solutions for professions in commercial, industrial and institutional markets with luminaires that are the hallmark of the industry. Crescent and Stonco, Philips Group Brands, are totally dedicated to this country’s concern for energy efficiency. The company manufactures a wide selection of energy-efficient lighting fixtures for office, warehouse, manufacturing and retail applications. Crescent and Stonco luminaires meet the stringent requirements of the Energy Policy Act of 2005, Title 19, Title 20, Title 24 legislation as well that of Energy Star program.
"Daylight Harvesting is the Integration of photo-electric sensors and electronic dimming ballast to into standard fluorescent fixtures. In that way the luminaires automatically adjust to maintain desired light level based upon available daylight. Crescent/Stonco Daylight Harvesting systems incorporate dimming ballast technology from Axis Technology and can provide annual energy savings of up to 30%."

What I was pointing out was the ridiculous nature of you beating the drum on a non-issue at this point. The 347 V DDH ballast is clearly a non-issue, and hasn't been an issue for over 2 1/2 years.
