On February 28, 2014, Republic of Texas Brands Inc. filed an adversary suit in United States Bankruptcy Court for the Northern District of Texas, Dallas Division against Empire Capital LLC, Scott Forsyth, and Matthew Nicoletti. RTXB seeks at least $3,000,000.00 in damages and at least $1,000,000.00 in other damages. On March 3, 2014, Empire Capital LLC, Scott Forsyth, Matthew Nicoletti, Michael Welch and another party filed a motion to have the bankruptcy converted to a chapter 7 or appoint a trustee. RTXB plans to fight this motion vigorously as we believe that the filing of the above motion was a response to our filing a suit against them. Find attached copies of both the lawsuit and the motion.
