Exactly, what is the judges mind when they (have to) consider all the extenuating circumstances particularly M/H lawsuit as will be argued by CERP's council Mr. Brady.

Right on Renee, Scheer planned this all along for a year. He spent time to scheme unwary shareholders instead of sales and contracts!

Renee, CERP is going to have to disclose those suits in the upcoming filings. While the Chap 7 issue will come before the BK filings are made, I wonder if Hanover can not force Chap 7 -- then maybe the route to go is to force a Trustee in place rather than let CERP remain DIP. A Trustee would at least come to a decision on whether the suits were valid, worth pursuing and of benefit to the company and its restructure efforts. It's the company that should benefit, if at all, not the bloke who put them in this mess.
