Apparently the door is open. All we need to do is get organized and take advantage of it (he said as if "getting organized" were a non-trivial effort).
edit isnt part of the problem a hang over from the old days. to tell the short interest ina stock, each brokerage has to maintain figures and then these figures from all the brokerage houses must be tallied together. In the days of paper and ATT telephones, I can imagine this would take some time, and like the AMT tax, this law is a hangover from a long time ago. the time period should not be needed now
