Litigation update. "final judgment" has been entered by the district court, and Momenta has appealed to the Federal Circuit. Momenta seems to have won some minor skirmishes in the District Court but whether it will amount to anything of consequence, I don't know. I would suspect that they expect to lose in the Federal Circuit, but may do so in a way that increases the chance that the Supreme Court will be interested in reviewing.
