Actually that's correct. You can use a marginable stock to buy a nonmarginable stock like JBII, it's held on margin, and it is available for shorting.

The irony of it all, the claim is an actual short position based upon share availability of 250,000 shares, so the claim is 249,800 shares were borrowed. How exactly would an actual short position occur if the account wasn't on margin?
