What does...."If the parties are unable to come to an agreement".....mean to you?
Followed by......"the Court FURTHER ORDERS the parties to schedule a settlement conference with the United States Magistrate Judge assigned to this case no later than December 1, 2013."
If they have no AGREEMENT by Dec 1,2013, that means they possibly haven't been talking, had no conference, so the judge is telling them......not talking ? No conferencng ? Okay, NOW you come to court no later than Dec 1,2013 with a DEFINITE date for a Settlement Conference.
No more playing mind games, I want a date!
You have to remember Vringo is not the sole party in this case, what they want is only 50% of the equation, maybe they tried to negotiate......and it fell on deaf ears.
So the ball has to get rolling.....with a definite date on a Settlement Conference.
Unless they agree on something before 12/1/2013.
The key word in the above order is....."schedule".
