Keep in mind that it is the WMI Litigation Trust board which decides what to pursue and what not to pursue. They have stated some of the initial targets (SG, D&O, Ratings Agencies) but there is nothing stated (or expected) for the WMILT to request the attorneys representing them to proceed against JPM in any civil capacity.
The WMILT is bound by the original exclusion and release for even "willful misdeeds" by JPM.
Olti I would say that those who did not give their releases have a better chance at getting something. BUT, if criminal wrongdoing can be proven, then the releases are no longer important and we have some kind of shot at additional recovery. GS is kind of in the same boat, and I think we have better chances there.
