Exactly. My feelings are that Berkowitz will do the best thing for his fund's shareholders. That might be giving up the commons fight in order to make sure that his prefs are taken care of. I've said it before: In negotiations you always need something to give so you can end up getting. The commons are throwaways to him and other hedgies, even if they own a substantial amount of common shares, it's peanuts compared to their pref value. He would throw commons under the bus to get his prefs paid out. No doubt in my mind.
Let's hope that Berkowitz or any of the other suits achieves his goals without destroying the commons.
