NAH. FANTASTIC DIVVY...here's how it works:

IF I CONTINUE TO HOLD MY STOCK AFTER A CORRECTIVE DISCLOSURE, WILL I BE PRECLUDED FROM PARTICIPATING IN ANY SETTLEMENT OF THE ACTION?

No, you can still participate in a settlement. In the event that you continue to hold the stock, your damages will be limited to the difference between the price paid for the stock and the mean trading price of that security during the 90-day period following the corrective disclosure.

So in your view, the current promotion that this is a divi is patently false, as you had to sell previously to be eligible for the any payment. Not surprising that some here are awaiting their payment, while claiming they never sold. Hmmm
I suppose getting the pps above .50 or even .70 may be important to some that are waiting to dump, even when they claim otherwise.
Funny stuff

"Those that are still holding don't receive the dividend?"
Of this I am certain: If you bought shares during the class period and still hold those shares at the time the settlement is finalized (I believe the Stipulation refers to this as the Effective Date), you would not be able to collect on a claim, even if those shares were worth less at that point than what you paid for them.
