They could file for cert again on the theory the Supreme Court might have denied cert last time because the lower court decision was not final. Now that summary judgment has been granted, that argument against cert is no longer valid. Or they can wait and hope the Court considers the issue in another case. I suspect they will file for cert again, given it does not cost much and there is a nonzero chance of success. But I wouldn't hold my breath.
