This was the latest response from NDEP, take it for what it is:

We have had some recent communication regarding Black Rocks desire to make modifications on how they deal with the tailings process water. They are attempting to improve water management issues that they have had in the past. I do not have any new information on when they plan to restart. They are required to give use prior notice so that we can perform a compliance inspection since they have been in temporary closure over the winter.
