Well, it is possible that the Supreme's will decide without asking for an amicus brief, given that the SG has already expressed some views on aspects of HW in its Classen brief. It's true the SG specifically stated it was not expressing a view on the Momenta v. Amphastar case, but perhaps they said enough for the Supreme Court to decide one way or the other on its own wihtut another brief from the SG. I also don't know whether the time the SG took in Classen was typical, if I get a chance I will poke around the Supreme court website and see if I can get a sense of how long it typically takes.
