I had not considered that aspect and very plausible. If true, puts a doubt in my mind of the rationality of re-trying the case. The defendant gets to pick judge or jury trial and in the case of Cisco it is clear it was a no-brainer for them to choose jury over a judge experienced in business law.

Thanks for your explanation, it passes Ockhams Razor theory for me.
