push: In patent licensing, there is a difference between wanting in and opting out. Microsoft signed an agreement to prevent NeoMedia from suing them. It is simply a risk mitigation technique unique to intellectual property. The calculation is made based on the cost of future litigation instead of being signed by an operating unit. Microsoft opted out with a royalty-free agreement - typically called CNTS agreement. NeoMedia investors seem to find the 'CNTS' term odious but it is a good deal for NeoMedia when companies license even if they are not interested in using the patents.
Progressive is another matter entirely because NeoMedia didn't (yet) deem it worthy of an 8K. That would be characteristic of a royalty-based agreement with a small or no initial fee. We may never know.
