If you read the rest of the 10Q, it cautions that the IRS could disagree with the abandonment loss and deny them, that legislation could change them retroactively, that causation out of their control could void them....all CYA.
Actually, CYA from people like those we see posting feverishly demanding "definitives" and who would hold their feet to the litigation fire if they promised something without telling them of the risks, even if they were remote. Everyone has been warned, these could be zero. That is the way the system works.
