I have no doubt that they absolutely know every shareholder of record as of close last Friday. What I don't know is the law. I don't know if the company has any legal responsibility to those who sold, or continue to sell thinking they will get the new issue of shares.
I agree that the only ones who win a law suit are the lawyers, but the US is the most law suit crazy society on the planet. I'm sure a raft of ambulance chasing lawyers would stand in line for the chance at a class action suit.
