Did you mean to say it might be announced some time in the future? Because it certainly hasn't been yet, contrary to the categorical but wrong statement in your post.

Frankly I doubt it will be settled out of court, given the seriousness of the charges against Bordynuik and JBII:

What filing? No SEC filing related to the recent offering was made that can't be found right here:

There would be no basis for the removal of an SEC filing and I don't believe I've ever seen it done.
