The dosing would still have to be precise enough to avoid the unwanted 'high'. People using THC for sleep apnea won't want to risk being stoned every night due to variability in the dosing. That probably rules out using the plant leafs in any form of ingestion. To take significant Sleep Apnea business away from Cortex, dispensaries would have to be selling THC itself, either synthetic THC like Dronabinol (Schedule 3 non-narcotic drug), or natural THC extracted from the marijuana plant (Schedule 1 illegal drug). Natural THC is still Schedule 1 according to Wikipedia, although that law could change.

I agree that basing Cortex's future on a THC drug is on the flakey side, but Varney was desperate to keep the doors open, and Pier had the $5 mil in NIH funding, so Varney couldn't be too choosey. But rather than now selling off the Ampakine assets to raise money, I'd personally rather see Varney partner all the respiratory programs ala a Biovail type deal and then use the money to run an ADHD Phase 2 using CX-1739. Not likely however.
