I hope that when the writing is on the wall, the smarter infringers look for a legal way out, before the judge decides what will happen.

If Kevin gives the infringers an out, that saves face and brings them into the royalty paying customer club, this may not drag on for all producers.

We have seen 'settlements' with no change of money and legal costs being shared already.

It is not a big stretch of the imagination to see that if settlements can be reached, which are not punitive and create customers going forward, some might see common sense. Especially given the good results GERS customers are seeing with oil recovery rates.

That's my wild optimistic conjecture for the day!

By way of reminder, DVG/ICM is not the only infringer, there are many others. Where a SJ is decided against the others, then any "insurance" from DVG/ICM does not mean that the latter becomes responsible to GERS for payment. Hence, any intransigence on DVG's part will not necessarily hinder settlement by all the other infringers and will therefore probably have limited impact.
