Leit - Yes, that is the point. The April 2005 was SUPPOSED to be "significantly" the same as the June 2004 contract (3% kicker) EXCEPT for the CXO entity change due their internal disagreemnet amongst themselves. But somehow the 8% kicker from the Feb 2004 contract appeared in the April '05 contract. The Board only disagreed with the kicker/succes language it appears. Apparently they had no other problems with the contract about CXO being there in perpetuity, etc.,
All I know is that I have never witnessed a company with such a calamity of errors. TOVC could make millions just by selling their story to the U of R for a grad course in Business Management for Case study in how not to do things.
