Well, gosh, its sorta like failing to file your taxes. Did you file you taxes? No ... well that's not good. But the IRS can't send you to the grey sheets. They can only fine you and even file charges if need be.
Did GTGP submit their required SEC filings? No .. well that's not good either. In this case the offense is not filing as required on multiple occasions. Of course, for all we know there could easily be far more serious charges pending. But the SEC is not gonna show their hand on that until such time as charges are filed.
As near as I can tell, GTGP has not filed for something like 5 years despite well established filing deadlines. There were numerous reminders over the years to get current. The SEC sets the filing deadlines and companies are obligated to comply. GTGP consisently failed to file.
SEC does not award do-overs. At some point they suspend and relegate to the greys. Game over. Point, set and match goes to the SEC.
