In ten years of following pinks, there has only been one company that was suspended by the SEC, dropped to the greys and actually went through the process of regaining its trading status. The company was Exobox, and the SEC did make a mistake. However, it took two years and hiring a consulting firm run by JC Watts, a former congressman to get the process completed.
The company subsequently failed due to mis-management.
The SEC is not trying to protect current investors but future investors, it's too late for current investors.
The suspension is an automatic process once started is automatically removed regardless of whether the company can or cannot prove their innocence. The SEC has already done an investigation and found "cause" to suspend.
Nope an H10 is only handed out when there is extremely strong evidence of improprieties. This will move to the greys and then possible charges and revocation will happen.
