You are totally wrong here there will not be a bk. It would be like robbing a bank and getting caught red handed but the money you robbed from the bank which is 2,000,000 you cant repay and just tell the govt that you are going to file bk even though you have 200,000,000 in your account. so no jail time and no repay of the funds just claim bk.....
