Yes, but more importantly it is wise to request summary judgment if the facts are not in dispute (e.g., if the court does not need live testimony). Without disputed material facts, it is wise to move for summary judgment with even a shaky claim.

Is it wise to request summary judgement if their counterclaim is bulletproof?
