When a photo is post on a public forum it is open to public review.
Once an item enters a public forum it is exempt from privacy laws. IE why you can be filmed walking down the street, bank ATMs, red light cameras...... All simply because you choose to enter a public place.
Same applies to a public medium IE the internet. Scott made the person in the photo public for all to evaluate.
