It is, but I think it still applies. They probably filed a from 12 to become exempt from filing, and opposed to CKMX it was apparently legitimate. However, that just made them non-reporting company - at which point the rules for non-reporting companies would go into effect and they would need the required paperwork for non-reporters.
Better to ask Matrix, I don't know anyone on this site who knows the regulations and requirements better.
