No, it means (if Bernstein is to be believed) that MNTA and NVS have actually held discussions about such an amendment.

It wouldn't be an amendment per se, but a clarification. As I stated here at one point, the royalty potentially could be reversed based on an argument as to good faith if the issue wasn't specifically addressed by the parties in drafting the contract.
